Form 1096: Annual Summary and Transmittal of U.S. Information Returns

Short answer

Form 1096 is the cover sheet that sends paper Forms 1099 to the IRS, one sheet for each form type, and it isn't used when you e-file. For 2026 payments, paper 1099-NEC and its 1096 are due Monday, February 1, 2027. Finbryn provides vendor tracking for small businesses, building the payment totals behind each 1099 before you or your preparer file.

Form 1096 at a glance

Official name
Annual Summary and Transmittal of U.S. Information Returns
Who files
Payers that file paper Forms 1097, 1098, 1099, 3921, 3922, 5498 or W-2G with the IRS. It is not used for e-filed returns, and filers of 10 or more information returns in total must e-file.
Due date
The due date of the forms it carries, or the next business day when that is a weekend or legal holiday. For 2026 payments: Monday, February 1, 2027 with paper Form 1099-NEC (January 31 is a Sunday) and Monday, March 1, 2027 with other paper Forms 1099 (February 28 is a Sunday). E-filed Forms 1099 other than the NEC are due Wednesday, March 31, 2027 with no Form 1096. There is no automatic extension for the NEC; Form 8809 gives other forms an automatic 30 days.Next due: (for a calendar-year filer)January 31 falls on a Sunday, so it moves to the next business day.
Extension
Form 8809
Penalty basis
Per return: $60 if corrected within 30 days of the due date, $130 by August 1, $340 after that or if not filed. The amounts are the same for returns due in 2026 and 2027; the yearly caps rise in 2027. Intentional disregard: at least $690 a return for 2027 filings. Filing on paper when e-filing is required can draw the same penalty.
Who signs
The payer, under penalties of perjury. A transmitter, paying agent or service bureau may sign for the payer under a valid agency agreement, with the caption "For: (name of payer)". The payer stays liable for penalties.
Where it goes
By first-class mail, in a flat mailer, to the IRS Austin, Kansas City or Ogden processing center for your state (the form lists them). Not needed for e-filed returns, which go through IRIS or FIRE.
How Finbryn fits

Key takeaways

  • Form 1096 only transmits paper information returns. If you e-file, you send no Form 1096.
  • Filing 10 or more information returns in total, W-2s included, means you must e-file, so many small employers never use a 1096.
  • Use a separate Form 1096 for each type of form, such as one for 1099-NEC and another for 1099-MISC.
  • For 2026 payments, paper 1099-NEC with its 1096 is due Monday, February 1, 2027. Other paper 1099s are due Monday, March 1, 2027.
  • The 1099-NEC and 1099-MISC threshold is $2,000 for payments made after 2025 and may be indexed from 2027.
  • A 1096 printed from IRS.gov can't be filed. Use the official scannable form, flat, by first-class mail.

What is Form 1096, and what is it used for?

Form 1096 is the summary page that travels with paper information returns to the IRS. It tells the IRS how many forms are in the envelope, how much federal income tax was withheld and the total amount reported. You attach it to Copy A of paper Forms 1099 (and 1097, 1098, 3921, 3922, 5498 and W-2G), and each 1096 covers one type of form only.

It's the 1099 counterpart of Form W-3, which does the same job for W-2s, except that W-2s go to the Social Security Administration, not the IRS. Who gets a 1099 and when are covered in the Form 1099 guide. This page covers the cover sheet. The Form W-2 and W-3 page covers the wage side.

Do you need Form 1096 if you e-file?

No. The IRS says not to use Form 1096 to transmit electronically. A return filed through the Information Returns Intake System (IRIS) or the older FIRE system is sent as data, so there's no paper to summarize. If your software e-files the 1099s for you, there's no Form 1096 at all.

E-filing isn't optional at volume. If you file 10 or more information returns during the year, you must e-file. The count adds every type together, W-2s included, so four 1099-NECs and six W-2s make 10. A filer who is required to e-file, has no approved waiver and files on paper can face the failure-to-file penalty of up to $340 per return, applied to the returns above 10. A waiver request on Form 8508 must be submitted at least 45 days before the due date.

IRIS is free. You need a Transmitter Control Code (TCC) first, and the IRS says the application can take up to 45 days, so apply before the season, not in January. A TCC works for one system only: an IRIS TCC won't work in FIRE.

When is Form 1096 due for 2026 payments?

Form 1096 follows the due date of the forms it carries. If that date falls on a Saturday, Sunday or legal holiday, it moves to the next business day.

Forms sentUsual dateFor 2026 payments, filed in 2027
Paper Form 1099-NEC with a 1096January 31Monday, February 1, 2027
Other paper Forms 1099 with a 1096February 28Monday, March 1, 2027
Forms 1099 other than the NEC, e-filed (no 1096)March 31Wednesday, March 31, 2027

For 2025 payments the paper dates were February 2 and March 2, 2026. There's no automatic extension for the 1099-NEC. For the other forms, Form 8809 filed by the due date gets an automatic 30 days. A mailed package counts as on time if it's properly addressed and postmarked by the due date, by the U.S. Postal Service or an IRS-designated private delivery service.

Did the $2,000 threshold change what goes in the envelope?

For payments made in 2026 and later, a Form 1099-NEC or 1099-MISC is owed at $2,000, up from $600. The IRS instructions say the figure applies to tax years beginning after 2025 and may be adjusted for inflation beginning in 2027. That confirms the figure in the Form 1099 guide, and it was checked against the December 2026 revision of the instructions on October 19, 2026.

The threshold changes how many forms you issue, so it changes the count in box 3 of your 1096 and whether you reach the 10-return e-file line. It doesn't change the 1096 itself. Royalties, with their separate $10 test, and Form 1099-K, which payment settlement entities file under their own rules, follow different thresholds.

How do you fill out Form 1096?

Use the official scannable form, not a printout. The filer's name, address and TIN must match the attached forms and your employment tax returns, or you may face penalties.

  • Box 1 or 2. Your EIN in box 1, or an SSN in box 2 for an individual not in a trade or business. A sole proprietor with no EIN uses box 2. Never both.
  • Box 3. The number of correctly completed forms, not pages. Leave out blank or voided forms and the 1096 itself.
  • Box 4. The total federal income tax withheld on the forms.
  • Box 5. The total of the amounts the form's instructions list for that type. The list differs by form, and the December 2026 Form 1099-NEC added boxes for cash tips and overtime, so check it against the revision you use.
  • Box 6. An X in one box only, for the type of form.
  • Signature, title and date. Group the forms by type and use a separate 1096 for each group.

Where do you send Form 1096, and how?

Send it by first-class mail, in a flat mailer, not folded, with Copy A of the forms. Send the entire page of Copy A even if one form on it is blank or void, and don't staple. The address depends on where your principal business is. New York, Texas and Florida use P.O. Box 149213, Austin, TX 78714-9213. Illinois, Michigan and Washington use P.O. Box 219256, Kansas City, MO 64121-9256. California, Pennsylvania and Maryland use 1973 North Rulon White Blvd., Ogden, UT 84201. Businesses outside the United States use Austin. The form lists every state.

Paper forms are read by machine, so a Form 1096 or Copy A printed from IRS.gov can't be filed. The IRS warns that a penalty may follow. Order official sets at IRS.gov/OrderForms. A private delivery service can't deliver to a P.O. box, so check IRS.gov/PDSstreetAddresses if you use one. Keep copies of what you filed, or the ability to rebuild the data, for at least 3 years from the due date, and 4 years if backup withholding applied.

How do you correct a paper 1099 and its 1096?

Use a new Form 1096 for corrections. For the same type of return, one 1096 can cover both originals and corrections, and you don't need to correct a 1096 you've already filed. If you discover forms you should have filed, send them with a new 1096 that doesn't repeat anything already filed. Never check the VOID box on a correction, because the scanner skips a voided form and the correction isn't recorded.

The e-file rule follows the originals. If your original returns had to be e-filed, so do the corrections, and a paper correction needs an approved waiver. A wrong W-2 isn't fixed on a 1096. It takes a Form W-2c, covered on the Form W-2 and W-3 page.

What do late, missing or wrongly filed returns cost?

The penalties attach to the 1099s and are charged per return, not on the 1096 itself. The per-return amounts are the same for returns due in 2026 and 2027: $60 if the correct return is filed within 30 days of the due date, $130 if it's filed after that but by August 1, and $340 after August 1 or if it's never filed. The yearly caps rise in 2027. The top tier is capped at $4,098,500 for returns filed in 2026 and $4,191,500 for returns filed in 2027, or $1,366,000 and $1,397,000 for a small business with average gross receipts of $5 million or less. The full table sits on the Form W-2 and W-3 page, because W-2s use the same schedule.

Intentional disregard costs at least $680 a return in 2026 and $690 in 2027, with no cap. Paper filed when e-filing was required counts, and so does a wrong or missing TIN. A late or wrong recipient copy draws a separate payee-statement penalty. Reasonable cause removes the penalty, and a dollar error of $100 or less, or $25 or less of tax withheld, needs no correction unless the recipient asks for one.

What does a small trades business actually send?

Illustrative example, made-up numbers. A plumbing contractor paid four subcontractors $2,000 or more in 2026 and has three employees.

Payee2026 payments for the 1099-NEC
Sub A$2,400
Sub B$5,100
Sub C$18,250
Sub D$7,650
Total$33,400

Four Forms 1099-NEC plus three W-2s make 7 information returns, under 10, so paper is allowed. The business completes one Form 1096: box 3 is 4, box 4 is $0 because nothing was withheld, box 5 is $33,400, and the X goes in the 1099-NEC box. The package is postmarked by Monday, February 1, 2027. The W-2s go to the SSA with a Form W-3 by the same date, in a separate mailing.

Three more returns of any type would reach 10. Then everything is e-filed, and no Form 1096 exists.

Who signs Form 1096?

The payer signs under penalties of perjury, with a title and date. A transmitter, service bureau, paying agent or disbursing agent can sign for the payer if it has authority under an agency agreement that's valid under state law and adds the caption "For: (name of payer)". Signing by an agent doesn't relieve the payer of the penalties for a late, incorrect or incomplete Form 1096 and the returns that go with it. Finbryn isn't an agent for this purpose and doesn't sign it.

The filer named on the form is the payer, not the helper. The IRS says to use your own name and TIN, the ones on your 94x employment tax returns, and not those of a paying agent or service bureau. A mismatch can draw information return penalties.

Where does Finbryn fit with Form 1096?

Finbryn doesn't file Form 1096, sign it or mail it. The payer signs, and you or your preparer file the 1099s. The work Finbryn does comes first. Vendor tracking tracks W-9 collection for each new vendor, flags TIN gaps, and keeps a running total for each vendor against the $2,000 line.

From that record, Finbryn prepares the draft 1099 figures and the 1096 counts and totals (boxes 3, 4 and 5) for your review. It also keeps a running count against the 10-return line, so you know in November whether you're e-filing. The 1099 and W-2 support page describes the year-end work.

Subcontractor payments matter outside tax season too. Travelers' premium audit page, checked October 19, 2026, asks for 1099s among the tax records it reviews. Finbryn organizes those records. Your carrier sets the premium, and Finbryn doesn't sell or advise on insurance.

What mistakes are easy to make with Form 1096?

These slips are easy to make with a form that looks like a formality.

  • Printing it from IRS.gov. The scanner can't read it.
  • One 1096 for several form types. Each type gets its own.
  • Counting pages in box 3. Count correctly completed forms.
  • A name or TIN that differs from your employment tax returns.
  • Mailing a 1096 with e-filed returns. E-filed returns go as data, so none is needed.
  • Missing the 10-return line. W-2s count toward it, so a payroll plus a few contractors can cross it.
  • Putting the 1099-NEC in the March batch. It's due with the first batch, on February 1, 2027.
  • Stapling or folding. Send it flat, unstapled.

Questions

Frequently asked questions

When is Form 1096 due?

For 2026 payments, Form 1096 is due Monday, February 1, 2027 with paper 1099-NEC, and Monday, March 1, 2027 with other paper 1099s, because January 31 and February 28 fall on Sundays. For 2025 payments the dates were February 2 and March 2, 2026. E-filed returns need no 1096. Checked October 19, 2026.

How do you file Form 1096?

You mail it with Copy A of your paper 1099s, by first-class mail in a flat mailer, one Form 1096 for each type of form. Or skip it by e-filing through IRIS, which is free and needs a TCC that can take up to 45 days. Filing 10 or more information returns in total requires e-filing. Checked October 19, 2026.

Where do you send or fax Form 1096?

The instructions give no fax option for the form itself. They list three mailing addresses by state. New York, Texas and Florida use P.O. Box 149213, Austin, TX 78714-9213. Illinois, Michigan and Washington use P.O. Box 219256, Kansas City, MO 64121-9256. California, Pennsylvania and Maryland use 1973 North Rulon White Blvd., Ogden, UT 84201. Checked October 19, 2026.

What is Form 1096 and what is it used for?

Form 1096 is the IRS cover sheet for paper information returns. It reports how many forms you're sending, the federal income tax withheld and the total amount reported, one sheet for each type of form. If you e-file, you don't use it. W-2s have their own cover sheet, Form W-3, which goes to the SSA. Checked October 19, 2026.

Where are the current instructions and PDF for Form 1096?

On IRS.gov under About Form 1096, with the General Instructions for Certain Information Returns. The 2026 Form 1096 was created December 15, 2025. The PDF is for reference only: the IRS says not to file a Form 1096 printed from its website, because paper forms are machine scanned. Order the official forms at IRS.gov/OrderForms.

What changes for Form 1096 in 2026?

The 2026 Form 1096 was created December 15, 2025, and the 2027 due dates shift because January 31 and February 28 are Sundays. What changes the work is the threshold: $2,000 for 1099-NEC and 1099-MISC payments made after 2025, indexed from 2027, which can cut the number of forms you send. Checked October 19, 2026.

Do you need Form 1096 if you e-file?

No. The IRS says Form 1096 is only for transmitting paper forms, so a return e-filed through IRIS or FIRE needs no cover sheet. You must e-file if you file 10 or more information returns in total, and W-2s count toward that number. As of October 19, 2026 the e-file threshold is 10.
